WHAT PERSONAL DATA CONCERNING YOU MAY BE COLLECTED

The following categories of your personal data may be collected:

· Contact details – information regarding name, place and date of birth, tax code, address, telephone number, mobile number, email address.

· Use of the website (Browsing data) – information relating to the way in which you use the site, open or forward our communications, including information gathered via cookies (you can find our Cookies Policy which regulates the details). Examples of these types of data are: IP addresses or domain names of the computers used by users that connect to the site, URI addresses (Uniform Resource Identifier) of the resources requested, time of the request, method used to submit the request to the server, size of the file obtained in response, numerical code showing the response given by the server (successful outcome, error etc.) and other information relating to the operating system and to the user’s IT environment.

 

HOW WE GATHER YOUR PERSONAL DATA

The Company gathers and processes Your personal data in the following situations:

· at the conclusion of one or more contracts with the Company;

· if you access the website to use its features, after registration on the site to create a special account for any future tourist reservations through our portal;

· if you contact us in order to request assistance;

· if other Companies and/or business partners lawfully transfer Your personal data to us.

· if You provide personal data on behalf of another person, you must ensure in advance that the persons concerned have read this Privacy Policy.

FOR WHAT PURPOSES YOUR PERSONAL DATA MAY BE USED

The processing of personal data must be legitimised by one of the legal prerequisites set out in the current legislation relating to the protection of personal data, as described below.

a) Processing for access history and portal use facility after creation of your own personal account, for marketing purposes to meet your needs and also to provide you with promotional offers in line with your preferences.  The Company may process Your contact details for commercial and marketing purposes and advertising aimed at informing You about promotional sales initiatives (relating to goods, services and events and initiatives promoted by the Company), through automated means of contact (email, sms, fax, telephone calls without operator, WhatsApp and other mass-messaging tools, etc.) and traditional means of contact (for example, paper based mail or telephone call from an operator) or for market research and statistical surveys, where You issue us with specific consent and within the limits of that described in the relative formula.

Processing condition: the consent. Failure to confer this does not have any consequence on the contractual relationships. Consent may be withdrawn at any time by clicking on the following link, or by writing to the email address privacy@veniceapartment.com.

b) Processing for marketing purposes relating to similar services/products to those requested by You. The Company may process Your contact details for marketing and advertising purposes aimed at informing You about promotional initiatives, through automated contact methods (email, SMS and other mass-messaging tools, etc.) and traditional contact methods (for example, telephone call from an operator) or for market research and statistical surveys relating to similar services/products to those requested by you.

Processing condition: legitimate interest of the Company in maintaining an effective contractual relationship with you.

c) Establishment and execution of contractual relations and consequent obligations, including any communication relating to services (for example, to implement any requests for assistance). The Company may process Your contact details for the purposes of any establishment and execution of contractual relations, provision of requested services and response to notifications and complaints. The Company will also be able to use Your contact details, in particular your email, to provide You with information relating to the service.

Processing condition: fulfilment of contractual obligations. The provision of data is obligatory for managing the contractual relationship; without it we will not be able to do so.

d) Operational management and purposes strictly related to it for access to the website. The Company may process Your contact details, and data about Your Usage of the website for: (i) managing Your services (and, in particular, Your notices); (ii) sending requests for contact or information or assistance.

Processing condition: fulfilment of contractual obligations. The provision of data is obligatory for responding to your requests; without it we will not be able to do so.

e) Compliance with legally binding requests to adhere to a legal obligation, regulations or provisions of the judicial authorities, as well as defence of legal rights.  The Company gathers Your contact details to comply with a legal obligation and/or to defend its own legal rights.

HOW WE KEEP YOUR PERSONAL DATA SECURE

The Company employs a wide range of security measures to improve the protection and maintain the security, integrity and accessibility of Your personal data. When processing the data using information technology, and in particular when using email, for statistical purposes and in order to monitor the correct reception and reading of the communication sent by the people concerned, the Proprietor will insert into those communications tags that enable verification of the reception, reading of the message and to check any links selected by the person concerned.

All your personal data are conserved on our secure servers (or secure paper copies) or on those of our providers or our business partners, and are accessible and usable based on our standards and our security policies (or equivalent standards for our providers or business partners).

 

FOR HOW LONG WE CONSERVE YOUR INFORMATION

We only conserve Your personal data for the time required to achieve the purposes for which they were gathered or for any other legitimate associated purpose or until exercise of your right of opposition ex art 21 GDPR. However, if the personal data are processed for two different purposes, we will retain those data until the purpose with the longer expiry date ceases.  However, we will no longer process the personal data for that purpose where the period of retention is shorter.

Access to your personal data will be restricted only to those that need to use them for relevant purposes.

Your personal data that are no longer required, or for which there is no legal basis to continue retaining them, will be anonymised irreversibly (and they may be retained in this way) or securely destroyed.

Below are set out the retention times in relation to the different purposes listed above:

a) Processing for the purposes of marketing to respond to your needs and also to provide you with promotional offers in line with your preferences: personal data processed for the purposes of marketing may be retained until you exercise your right of opposition to receiving further communications;

b) Processing for the purposes of marketing relating to similar services/products to those requested by You: personal data processed for the purposes of marketing may be retained until you exercise your right of opposition to receiving further communications;

c) Fulfilment of contractual obligations: data processed for the fulfilment of any contractual obligation may be retained for the entire duration of the contract but not beyond the subsequent 10 years, in order to verify any liabilities including accounting records (for example, invoices).

d) Operational management and purposes strictly related to it for access to the website: data processed for this purpose may be retained for the entire duration of the contract but not beyond the subsequent 10 years.

e) In the case of legally binding requests and/or disputes: if the need arises for us to defend ourselves or to act or also to bring a claim against You or any third party, we may retain the personal data which we deem reasonably necessary to process for those purposes, for the time that the claim may be pursued.

 

WHO WE SHARE YOUR PERSONAL DATA WITH

Those who may have access to Your personal data are duly authorised personnel, as well as external providers who, as data processors, provide support in the supply of the services.

In particular, for the performance of the majority of its activities, the Company also deals with external companies, professionals/consultants/technicians, with whom it has finalised specific agreements, such as for:

· the performance of data processing and transmission services or general information technology services;

· the performance of installation, maintenance and upgrade work aimed at ensuring the optimal functioning of fixtures, installations and procedures;

· carrying out appraisal activities, financial audit, certification of accounts, professional consultancy and client support;

· carrying out audit, review and certification activities;

· carrying out data archiving activities and communication/documentation of relationships with clients, providers, personnel, partners and other persons;

· carrying out client support activities (call centre/help desk etc.);

· customer satisfaction surveys;

· As specified in the previous section, with regard to the so-called «A type purposes», the data may also be communicated and/or ceded for promotional purposes, after receiving Your consent for these purposes, to parties operating in the sector of  Classified Advertising (on-line announcement sites), Marketing Automation, Email Marketing, Social Media and SMS marketing, as well as operators in telecommunications (including on-line) and/or in the energy sector and in any case to:

YOUR DATA PROTECTION RIGHTS AND YOUR RIGHT TO FILE CLAIMS BEFORE THE SUPERVISORY AUTHORITY

The interested party has the right to ask the Proprietor for access to their own data in accordance with article 15 of the GDPR, the amendment of the data in accordance with article 16 of the GDPR, to obtain deletion of the data in the cases referred to in article 17 of the GDPR, to obtain limitation of the use of the data by the Proprietor in the case where the conditions apply as laid down in article 18 of the GDPR, to be opposed to the processing of the data in accordance with article 21 of the GDPR and, finally, to obtain, in accordance with article 20 of the GDPR, portability of their data to another Proprietor.
